Seller Terms
Last updated: September 5, 2026
These Seller Terms supplement the general Terms of Service and apply specifically to users who list projects for sale on DevMarket ("Sellers"). By listing a project, you agree to these additional terms.
1. Eligibility
To list a project on DevMarket, you must be at least 18 years old and have the legal authority to sell the project and its associated assets, including source code, domain names, customer data, and third-party accounts.
2. Accurate Information
Sellers must provide truthful, accurate, and complete information in their listings, including but not limited to:
- Monthly revenue and expenses
- Active user and customer counts
- Technology stack and architecture
- Reason for selling
- What is included in the sale
Misrepresenting metrics or providing fraudulent data will result in immediate listing removal and permanent account suspension without refund.
3. Listing Fees
A one-time, non-refundable listing fee is required to publish a project. This fee grants your listing visibility on the marketplace for as long as it remains published. DevMarket does not charge any commission or transaction fee on the final sale.
4. Intellectual Property
By listing a project, you confirm that you own or have the legal right to sell all assets included in the listing. You are solely responsible for ensuring the sale does not infringe on any third-party intellectual property rights, licenses, or agreements.
5. Prohibited Listings
The following types of listings are strictly prohibited:
- Projects with stolen or pirated code
- Products that violate third-party terms of service (e.g., API key abuse)
- Listings containing malware, spyware, or malicious code
- Projects with falsified revenue, traffic, or user metrics
- Websites or apps promoting illegal activities
6. Buyer Communication
Sellers must respond to buyer inquiries in good faith and in a timely manner. While negotiation is at your discretion, intentionally misleading buyers during communications may result in account suspension.
7. Asset Transfer
Once a sale is agreed upon, the seller is responsible for transferring all specified assets to the buyer, including source code, documentation, domain names, hosting accounts, and any other items listed as included. Failure to complete the transfer may result in account suspension and legal action.
8. Listing Review & Removal
DevMarket reserves the right to review, edit, or remove any listing that violates these Seller Terms, our Terms of Service, or any applicable law. We may also request additional verification of metrics or ownership.
9. Limitation of Liability
DevMarket acts solely as a listing platform and is not a party to any transaction between buyers and sellers. We are not liable for disputes, misrepresentations by either party, or failure to complete a transaction.
